Cat Nap Blocks: Cozy Puzzle ("Cat Nap Blocks", "the game") is owned and operated by Emerge Labs LLC, 2108 N St Ste N, Sacramento, CA 95816, United States ("we", "us"). These terms are an agreement between you and Emerge Labs LLC. By downloading, installing or playing the game you agree to them, to our Privacy Policy, and to Apple's Licensed Application End User License Agreement ("Apple's EULA"). If these terms and Apple's EULA conflict, Apple's EULA applies. If you don't agree, don't download or play the game.

Who can play

You must be old enough to accept these terms where you live, or have a parent or guardian accept them for you. Parents and guardians are responsible for a minor's use of the game, including any purchases made on their Apple ID.

Your licence to play

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and play the game on Apple devices you own or control, for your own non-commercial entertainment, as allowed by Apple's EULA. You may not copy, sell, rent, sublicense, modify, translate, reverse-engineer, decompile or disassemble the game, extract its art, music, code or other assets, or make derivative works from it, except where the law expressly allows it.

Who owns the game

The game and everything in it (its code, art, characters including Tabby the cat, names, logos, music and sound we created, and its design) belong to Emerge Labs LLC or our licensors and are protected by copyright, trademark and other laws. "Cat Nap Blocks", "Tabby's Universe" and their logos are our trademarks. Some sound effects are used under public-domain (CC0) licences and some fonts under the SIL Open Font License. These terms don't give you any ownership of the game or its content.

Fiction and no affiliation

Tabby and every other character in the game are fictional. Any resemblance to real persons or animals, or to characters, games, brands or products owned by others, is coincidental and not intended. Cat Nap Blocks isn't affiliated with, sponsored by or endorsed by any other game, company, brand or rights holder. Block-placing, line-clearing puzzles are a common game genre and aren't claimed by us or anyone else.

Apple, iPhone, Game Center and the App Store are trademarks of Apple Inc. Google and Firebase are trademarks of Google LLC. All other trademarks belong to their owners. Their mention describes the services the game uses and doesn't imply endorsement.

If you believe something in the game infringes your rights or is mistaken for your work or brand, email us at the address below with what it is, where it appears, and why. We'll review every good-faith report promptly and change or remove content where appropriate.

Health notice

The game has sparkles, flashes and moving patterns when lines clear. A small number of people may have seizures or other reactions to these. If you or anyone in your family has epilepsy or a history of seizures, check with a doctor before playing. Stop playing at once if you feel dizzy, sick, or notice eye or muscle twitching, and take regular breaks.

Virtual items and purchases

Fish, rooms, rescue pieces, continues and other in-game items ("virtual items") are licensed to you for use in the game only. They aren't your property, have no real-world value, can't be exchanged for real money or anything of value, and can't be sold or transferred. We may change, rebalance or remove virtual items and their prices. Fish and other consumable items are stored on your device and may be lost if you delete the game. Rooms are one-time purchases that you can restore from the App Store on the same Apple ID.

Purchases are processed by Apple and are subject to the App Store's terms. All sales are final except as required by law or by Apple's refund policy; ask Apple for refunds. Prices are shown before you buy. The game has no subscriptions.

No ads

The game shows no ads. Daily rewards and the first free continue each day are given by the game itself and may change or stop at any time.

Game Center and other players

Leaderboards are provided through Apple Game Center. Your Game Center nickname and scores may be visible to other players. Be respectful, don't cheat or impersonate others, and don't use offensive nicknames. We don't control or monitor other players or Apple's services, and we aren't responsible for what other players do.

Fair play

Don't cheat, use bots, exploit bugs, change your device clock to farm daily rewards, modify the game or its saved data, or interfere with leaderboards or other players. We may remove scores, reset progress or limit features that result from cheating or from breaking these terms.

Feedback

If you send us ideas, suggestions or feedback, you allow us to use them without payment or credit. Please don't send us ideas you consider confidential.

Third-party services

The game relies on services from Apple (App Store, Game Center, in-app purchases and SKAdNetwork) and Google (Firebase Analytics). Your use of them is also governed by their own terms and privacy policies, and we aren't responsible for them.

Changes and availability

We may update, change, suspend or stop offering the game, any feature or any content at any time, with or without notice, and updates may be required to keep playing. We'll update the date above when these terms change; continuing to play after a change means you accept it.

Ending your licence

You can stop at any time by deleting the game. Your licence ends automatically if you break these terms. Sections on ownership, fiction and no affiliation, disclaimers, liability, indemnity and disputes survive the end of your licence.

Disclaimer of warranties

To the fullest extent allowed by law, the game is provided "as is" and "as available", with all faults and without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We don't promise that the game will be uninterrupted, error-free, secure, or that progress, scores or virtual items won't be lost.

Limitation of liability

To the fullest extent allowed by law, Emerge Labs LLC and its owners, employees and contractors aren't liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost progress, data, virtual items, profits or goodwill, arising from or related to the game or these terms, even if we were told they were possible. Our total liability for all claims is limited to the greater of the amount you paid us for the game in the 12 months before the claim, or US $50.

Indemnity

You agree to defend and hold harmless Emerge Labs LLC and its owners, employees and contractors from claims, losses and costs (including reasonable legal fees) arising from your misuse of the game or your breach of these terms.

Your rights under local law

Some places don't allow certain exclusions or limits of liability. Where that's the case, those parts apply only as far as the law allows. Nothing in these terms limits rights you have as a consumer that can't be waived by contract.

Disputes

Before any formal claim, please email us so we can try to resolve it informally within 30 days. These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts in Sacramento County, California, and you and we consent to their jurisdiction, except that either of us may bring a claim in small-claims court, and consumers in the EU, UK or elsewhere may also use the courts where they live if their law gives them that right. To the extent allowed by law, claims must be brought individually, not as part of a class or representative action.

Apple terms

These terms are between you and Emerge Labs LLC, not Apple. Apple isn't responsible for the game or its content, and has no obligation to provide maintenance or support for it. If the game fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the extent allowed by law, Apple has no other warranty obligation. Apple isn't responsible for any claims relating to the game, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer-protection claims, or claims that it infringes someone else's intellectual property; we, not Apple, are responsible for investigating, defending and settling such claims. You confirm that you aren't located in a country subject to a US government embargo or listed on any US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

General

These terms, the Privacy Policy and Apple's EULA are the whole agreement between you and us about the game. If any part is found unenforceable, the rest stays in effect. Not enforcing a part isn't a waiver of it. You can't transfer these terms; we may transfer them, for example if the game is sold.
