Five Skies · Terms of Use
Last updated: October 26, 2026
These terms are an agreement between you and Emerge Labs LLC, 2108 N St Ste N, Sacramento, CA 95816, United States ("we", "us"), about Five Skies, the prayer times app for iPhone and iPad ("the app"). By downloading or using the app you agree to them. If you don't agree, please don't use it.
Your licence to use the app
We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, as allowed by Apple's Usage Rules. You may not copy, sell, rent, modify, reverse-engineer or redistribute the app, except where the law allows it despite this limit.
Prayer times, the Qibla and the calendar
The app is a helpful guide, not a religious authority. Please read this carefully:
- Prayer times are calculated estimates. They come from astronomical formulas, your location and the calculation method and Asr rule you choose. They can differ from your local mosque's timetable by a few minutes or more, especially at high latitudes. When in doubt, follow your local mosque or scholars.
- The Qibla is calculated as the great-circle direction from your location to the Kaaba. The arrow depends on your device's compass, which can be thrown off by metal, magnets and poor calibration.
- Hijri dates follow the Umm al-Qura calendar. Where months begin with a local moon sighting, dates (including the start of Ramadan and the Eids) can differ by a day.
- The rak'ah guide, the Zakat calculator and similar tools follow common practice and are simplified. Schools of thought differ. The Zakat calculator is an aid, not financial or religious advice; please confirm amounts and nisab with a scholar.
- Alerts depend on iOS notifications, your device's settings and its battery and focus modes. Don't rely on the app as your only reminder.
Who owns the app and its content
The app, its design, artwork, mosque illustrations, code and text belong to Emerge Labs LLC or our licensors. Some content is used under open licences, credited in the app's About page:
- The Quran text is from the Tanzil Project (tanzil.net), under the Creative Commons Attribution 3.0 licence; the English translation is by Marmaduke Pickthall.
- The adhan was recorded at Malmö Mosque by the Islamic Center Malmö, under the Creative Commons Attribution 3.0 licence, via Wikimedia Commons; it is trimmed, faded and level-adjusted.
- Ambient sounds are by cribbler, tenkism and sengjinn on Freesound, released under CC0.
Nothing in these terms takes away rights those licences give you.
Purchases
The app is free to download. Extra mosque designs for the Today screen, and Supporter (which supports the app, keeps it free without ads, and opens every mosque design), are optional one-time in-app purchases sold through the App Store. They're non-consumable: you buy each one once and can restore it on your other devices with Restore Purchases. There are no subscriptions. Prices are shown in the App Store and may change; a price change never affects what you've already bought. Payment, billing and refunds are handled by Apple under its terms. To ask for a refund, go to reportaproblem.apple.com.
No ads, no accounts
The app has no ads and no accounts. How we handle data is described in our Privacy Policy.
Third-party services
Some features rely on Apple's services: maps and place names, Nearby Mosques search and directions, notifications, widgets and Live Activities, and the App Store. They're provided by Apple under its own terms, and we're not responsible for their availability or accuracy, including mosque listings on the map.
Feedback
If you send us ideas or suggestions, we may use them without owing you anything.
Changes and availability
We may update the app, add or remove features, or stop offering it. We'll try to keep what you've bought working. We may update these terms; the date above shows the latest version, and continuing to use the app after a change means you accept it.
Disclaimer of warranties
To the fullest extent allowed by law, the app is provided "as is" and "as available", with all faults and without warranties of any kind, express or implied, including accuracy, merchantability, fitness for a particular purpose, title and non-infringement. We don't promise that the app will be uninterrupted or error-free, that prayer times, the Qibla, dates or calculations will be exact, or that data on your device won't be lost.
Limitation of liability
To the fullest extent allowed by law, Emerge Labs LLC and its owners, employees and contractors aren't liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost data, profits or goodwill, arising from or related to the app or these terms, including a missed or mistimed prayer, fast or alert, even if we were told they were possible. Our total liability for all claims is limited to the greater of the amount you paid us for the app in the 12 months before the claim, or US $50.
Indemnity
You agree to defend and hold harmless Emerge Labs LLC and its owners, employees and contractors from claims, losses and costs (including reasonable legal fees) arising from your misuse of the app or your breach of these terms.
Your rights under local law
Some places don't allow certain exclusions or limits of liability. Where that's the case, those parts apply only as far as the law allows. Nothing in these terms limits rights you have as a consumer that can't be waived by contract.
Disputes
Before any formal claim, please email us so we can try to resolve it informally within 30 days. These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts in Sacramento County, California, and you and we consent to their jurisdiction, except that either of us may bring a claim in small-claims court, and consumers in the EU, UK or elsewhere may also use the courts where they live if their law gives them that right. To the extent allowed by law, claims must be brought individually, not as part of a class or representative action.
Apple terms
These terms are between you and Emerge Labs LLC, not Apple. Apple isn't responsible for the app or its content, and has no obligation to provide maintenance or support for it. If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the extent allowed by law, Apple has no other warranty obligation. Apple isn't responsible for any claims relating to the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer-protection claims, or claims that it infringes someone else's intellectual property; we, not Apple, are responsible for investigating, defending and settling such claims. You confirm that you aren't located in a country subject to a US government embargo or listed on any US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
General
These terms, the Privacy Policy and Apple's EULA are the whole agreement between you and us about the app. If any part is found unenforceable, the rest stays in effect. Not enforcing a part isn't a waiver of it. You can't transfer these terms; we may transfer them, for example if the app is sold.
